The Act prohibits the hunting of wild mammals with dogs in Scotland, subject to exceptions. It establishes a summary offence carrying a penalty of up to six months imprisonment or a fine for: a person who deliberately hunts a wild animal with a dog; a dog owner who allows another to use it to do so; and an owner or occupier of land who knowingly permits another to use their land for this purpose. The exceptions relate to the use of a dog in connection with falconry and shooting; the search by authorised persons, such as a local authority officer, to catch a wild mammal without an intention of harming the animal; the retrieval, location and rescue of wild animals which have escaped or been injured; and other excepted activities.
