The Act implements a number of recent policy commitments regarding care provision in Scotland, made by the Scottish Executive following consultation. Provisions include: the implementation of free nursing and personal care; the regulation of charges for non-residential social care; residents or third parties can make additional payments towards care home fees (on top of local authority payments) so that the resident can enter more expensive accommodation if desired; placement in care homes in other parts of the UK; the creation of deferred payment agreements with local authorities so that residents of care homes do not need to sell their own home in their lifetime; and the expansion of direct payments for non-residential service users, to enable people to purchase their own services.
