Covert Human Intelligence Sources Code of Practice Pursuant to Section 71 of the Regulation of Investigatory Powers Act 2000

This code of practice provides guidance on the authorisation of the use or conduct of covert human intelligence sources ("CHIS") by public authorities under Part II of the Regulation of Investigatory Powers Act 2000. This code is issued pursuant to Section 71 of the 2000 Act, which stipulates that the Secretary of State shall issue one or more codes of practice in relation to the powers and duties in Parts I to III of the 2000 Act, section 5 of the 1994 Act and Part III of the 1997 Act. This code replaces the previous code of practice issued in 2010.
This code should be readily accessible by members of any relevant public authority seeking to use the Regulation of Investigatory Powers Act 2000 to authorise the use or conduct of CHIS. The 2000 Act provides that all codes of practice relating to the Act are admissible as evidence in criminal and civil proceedings. If any provision of this code appears relevant to any court or tribunal considering any such proceedings, or to the Investigatory Powers Tribunal established under the Act, or to one of the Commissioners responsible for overseeing the powers conferred by the Act, it must be taken into account.
